Cloud Terms of Use Chapter 1 (General Provisions) Article 1 (Purpose) 1. This agreement (hereinafter referred to as "Cloud Terms of Use") is a website/service operated by “Yaskawa India Pvt. Chapter 2 Individual Member Registration Article 3 (Application for Individual Member Registration) 1. After the application for registration is completed along with all the necessary data, the applicant receives the notification that the registration is completed from the company and the applicant becomes an individual member. Article 4 (Refusal and cancellation of registration application) 1. The Company may confirm the application or registration contents at the time of application for registration or after completion of registration. As a result of the confirmation, if it is found that any of the following items is applicable, at our discretion, the registration applicant or individual member after registration (hereinafter referred to simply as "registration applicant" in this Article) can be refused or the registration can be cancelled, and no objection by the applicant will be accepted. (5) When the applicant for registration is working for an electrical equipment manufacturer or other corporation that has a competitive relationship with our company (whether in India or abroad) (6)When the applicant has violated this agreement, or when there is a risk of violation. Chapter 3 Use of this service Article 5 (Contents of this service) 1.Members shall bear all communication charges and other costs incurred as a result of using this service and using the application downloaded through this service. 2. When using the technical information downloaded using this service, members shall read the precautions carefully and use it with proper handling. 3. This service is provided only for our products that support this service, and not for all products in general. In addition, our products for which this service is provided are subject to change without notice, and we shall not be liable for any damages caused to the members. Article 6 (Change of Cloud Terms of Use) 1. We may change the Cloud Terms of Use as needed at any time without obtaining the consent of the members. Chapter 4 Members' Compliance Matters, Our Rights and Obligations Article 7(Responsibility for ID and Password Management) 1. To use this service, you need the ID (user identification number) notified by us when registration is completed and the password (personal identification number) set by individual members (collectively "passwords" below). Members shall use and manage their own passwords. (1) Manage passwords at your own risk. If the member forgets the password, etc., this service may not be available. (2) Do not transfer, lend, or use passwords to a third party, share one password with multiple people, or impersonate another person (including other members) to use this service. (3) If you become aware of the fact that your password has been stolen or that it has been used by a third party, you must notify us immediately. 2. Members can change their passwords by the procedures specified by our company. 3. The Company may request the member to change the password in the event of a problem 4. If you forget your password, you can request us to reissue it. In this case, we will reply to the request by the method prescribed by our company, such as for personal identification. 5. If the Company suffers damage due to intentional or negligence in the use and management of passwords, etc., the Company shall request the member to compensate for the damage. Article 8 (Prohibited acts of members) Members shall not engage in any of the following actions when using this service. (1) Acts that violate the terms of use and other requirements that are well known on this service. (2) Acts that attempt or implement unauthorized access, such as unauthorized access to our system, Acts that prevent the smooth operation of this service, such as unauthorized access to acquisition and use of information, unauthorized acquisition and falsification of information, and the use of harmful programs. (3) Harmful software that have the potential to affect our information systems and Acts of transmitting data. (4) Acts that may harm the rights and interests of the Company and third parties. (5) Acts that harm public order or good manners and customs. (6) Other acts that may interfere with the operation of this service. Article 9 (Disclaimer) 1. We do not guarantee that the purpose will be met. It is the responsibility of the member to select, introduce, and use the information on this service, and we are not responsible for the result. 2. In addition to the provisions of each article including this article, we will not be liable for any damages caused to a member or a third party as a result of an act performed by a member in violation of this agreement. Chapter 5 General Provisions Article 10 (Information on products and technologies provided by members) 1. (2) Interruption or malfunction of the online system due to force majeure cases. (3) In addition, if there is an operational or technical reason for this service. 2. The Company shall not be liable for any consequences caused to members or other third parties due to the suspension or termination of this service specified in the preceding paragraph. Article 13 (Handling when there is no use for a long time) 1. If the member has not logged in to this service for more than a year since the last login, or the email sent from our company to the email address registered by the member did not reach the recipient three times in a row we may withdraw the member at our discretion. 2. The Company shall not be liable for any damage caused to the Member due to the withdrawal of the Member based on the preceding paragraph. Article 14 (Information after withdrawal) Regardless of the reason for withdrawal, we will immediately delete the registered information of the withdrawn member from the registration information server. Article 15 (Change of this agreement) 1. Our company can change this agreement as needed at any time without obtaining the consent of the member. 2. We will make changes to these Terms by posting the changes on our website, and at the time of posting, the changed Terms will become effective and will be applied to members. Article 16 (Governing Law and Court of Jurisdiction) In the event of a dispute between the Company and its members, Karnataka Uccha Nyayalaya shall be the exclusive court of first instance.
